Terms of Service Change History

LawPay

Expanded grounds for account termination

NEW version adds explicit right to terminate if merchant fails to notify 8am of changes to merchant profile (ownership changes, business opening/closing, bankruptcy, new agreements affecting the account). OLD version did not clearly state this termination right for failure to notify.

Effective: September 11, 2026

New settlement account change procedures

NEW version requires merchants to contact Customer Support or Relationship Manager to change settlement accounts, establishing a formal process. OLD version had no explicit guidance on settlement account changes.

Effective: September 11, 2026

Explicit liability disclaimer for authorized but disputed payments

NEW version explicitly states 8am is not responsible for authorized and completed payments that later become disputes, refunds, reversals, or are submitted without authorization. OLD version did not have this clear liability limitation statement.

Effective: September 11, 2026

Geographic eligibility restrictions clarified

NEW version explicitly limits account eligibility to US states, DC, Puerto Rico, and Canada, and specifically excludes US territories (Guam) and military bases. OLD version had no stated geographic restrictions, potentially affecting existing merchant eligibility.

Effective: September 11, 2026

Rebranding and document restructuring

NEW version rebrand from 'AffiniPay' to '8am' with significant document restructuring, renaming 'Program Terms and Conditions' to '8am Payment Solution User Guide' and cross-referencing a separate '8am Terms of Service.' This indicates material reorganization of contractual terms.

Effective: November 1, 2025
