Unilateral Account Termination Without Notice

NEW: Cheba Hut can now terminate or suspend access to the Site 'without prior notice or liability, for any reason.' OLD: No explicit termination clause existed. This gives the company broad power to remove user access immediately without explanation or opportunity to cure violations.

User-Submitted Content Rights Removed

OLD: Users' submitted content became 'forever the property of Cheba Hut' with rights to use it 'for any commercial or other purpose.' NEW: This section is completely removed from the new ToS. The company no longer claims perpetual ownership of user-submitted content, which is more favorable to users.

Effective: August 25, 2026

Liability Cap Added and Narrowed

NEW: Total liability is now capped at 'the amount you paid for the product(s).' OLD: Stated liability was limited only by state law and excluded indirect/consequential damages but had no monetary cap. This significantly limits Cheba Hut's financial exposure for claims.

Governing Law Clause with Incomplete Jurisdiction

NEW: Terms reference '[State]' and '[State/County]' as placeholders for governing law and exclusive jurisdiction but do not specify actual locations. This creates ambiguity about which courts have jurisdiction and which state's law applies, potentially making dispute resolution more difficult for users.

Age Eligibility Increased from 13 to 18

OLD: Users aged 13-18 could access the Site under parental supervision. NEW: Only users 18+ can purchase merchandise; younger users are effectively excluded. This restriction is narrower and removes the supervised-use option for minors.
